What is Pro-forma Promotion?

Pro-forma promotion is a corrective mechanism: it restores an employee to the seniority position and pay they would have held if a promotion had not been wrongly delayed or withheld. It does not mean an extra or premature promotion — it repairs the record where one was unjustly denied.

What pro-forma promotion means

When an employee is later found to have been eligible for promotion at an earlier date — say, after acquittal in a disciplinary case, or once a court or appellate authority sets aside a wrongful supersession — the promotion is granted with effect from that earlier, notional date. Pay and seniority are fixed as if the promotion had happened on time, even though the actual posting and charge of duties may follow later.

When it applies

  • An employee under suspension or facing disciplinary/vigilance proceedings is later exonerated, and would otherwise have been promoted during that period.
  • A promotion was wrongly withheld and is subsequently restored by appeal, review, or court order.
  • A post could not be given charge of immediately (no vacancy, ongoing proceedings elsewhere) but the employee's eligibility for that grade is not in doubt.

How it protects pay and seniority

The employee's seniority in the higher grade is fixed from the notional date, protecting their position relative to juniors who may have been promoted in the interim. Pay is refixed accordingly, and consequential benefits — increments, further promotion eligibility — flow from that corrected date. Arrears of pay for the intervening period depend on the specific order and the circumstances of the case.

Pro-forma promotion corrects the record — it is not a new or additional promotion.
